Dacia Club Nederland ("we", "us" or "our") is an association based in the Netherlands. By using daciaclubnederland.nl ("Platform”), you agree that you have read, understand, and accept the terms and conditions described below, and you agree to be bound by these terms, policies, and guidelines incorporated in the Terms of Service by reference.
Account
An account may be required to use some parts of our platform. This account will let you post content, communicate with others, and many more things. When creating an account, you agree to the following:
- You are not younger than the age legally defined as an adult in the country you reside in.
- You are responsible for all uses of your account, including but not limited to purchases and sharing information.
- If you are using your account on behalf of a third party, you agree, and promise to have the authority to agree, to these Terms of Services on behalf of yourself and the third party involved.
- We may remove, suspend, limit, or modify an account for any reason with or without notice if we believe that the use of the account puts us or other users at risk.
Privacy
Our Privacy Policy describes how we handle and protect the information you provide us when you sign up for an account or use our platform. You understand that through your use of our platform you consent to the collection and processing of this information as described in the Privacy Policy.
Purchases & Refunds
We may offer (paid) upgrades and additions to existing functionality. We may also offer paid subscriptions, which allow access to some parts of our platform as well as unlocking additional benefits. We may offer discounts or trials at any point in time, with no credit card required. If you don't pay or renew on time, we reserve the right to revoke or limit your license or access to any paid feature or benefit.
We have a 30-day refund policy for all purchases made on our platform. To request a refund, please contact us through a ticket or email. Processing of these requests may take up to 5 business days.
Content
You are responsible for your use of our platform and any comments, feedback, graphics, data, text, or other content you provide or post, including compliance with applicable laws, rules, and regulations. You are also responsible for any damage arising out of breaking these terms, laws, rules, and regulations.
Any use or reliance on any content or materials posted via our platform or obtained by you through our platform is at your own risk. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any content or communications posted via our platform or endorse any opinions expressed via our platform.
We reserve the right to remove, modify or hide any content that we think violates our Code of Conduct, these Terms of Service or any other applicable laws, rules, and regulations.
License Restrictions
While we give you the right to use our platform when accepting these Terms of Service, there are limitations on which behavior is allowed. You are not allowed to do anything listed below, unless otherwise stated in a separate contract:
- Modify, copy, or create derivative works based on content posted by us or others unless express written permission is given.
- Reverse engineer, decompile, decode or disassemble the source code of our platform.
- Bypass, breach, or attempt to break any protection used by our platform.
- Modify, replace, or remove any copyright, trademark, or other intellectual property from any content that you did not create.
- Perform actions that negatively impact how others use our platform, breaks any policy referred to by these Terms of Service, or breaks any laws, rules, and regulations applicable.
Security researchers are allowed to attempt gaining access to our platform, under the condition they do not publicly disclose information regarding how, nor do they publicly disclose any data obtained from doing so. They promise to notify us of any security-related issue by contacting us here.
Communications
You agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our platform. For any other communications, we will make sure to get your consent and also make it easy for you to opt out of these communications.
Code of Conduct
Our platform provides ways for you to communicate with us, dealerships, or other users. By communicating or posting content on our platform, you agree to adhere to our Code of Conduct.
Termination and Suspension
We reserve the right to disable, remove, or change some or all functionality on our platform, with or without notice and without any liability to you or anyone else.
Intellectual Property
We have ownership of the intellectual property rights to our platform, including the functionality, graphics, content and software/code that our platform is built on or with. In case we use anything that isn't our own, the rights will belong to the respective party that created said material.
When providing, posting, or publishing content on our platform, you grant us the right to use your content to facilitate our platform to you and other users. In any case, content provided by you and which you have the rights to, will stay yours. We do not claim any ownership rights on content we do not create or own. Some of your content may contain personal data. Our use of personal data is subject to our Privacy Policy.
Copyright Infringement
As stated above, we respect the rights to intellectual property. If you believe your copyrighted work has been copied or posted in a way that constitutes copyright infringement, please contact us here with the following information:
- A description of the copyrighted work or other intellectual property that you claim has been infringed;
- A description of where the material that you claim is infringing is located, with enough details that we are able to find it;
- Your address, telephone number, and email address where we can contact you;
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright;
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law;
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.
If you submit a notice of infringement that knowingly materially misrepresents that any content on our platform is infringing upon a copyright, you may be held liable for damages and attorneys’ fees.
When a notice is received, we will act as an intermediary between you and the allegedly infringing party. If the other party cannot show any evidence to counter your infringement notice, the content or intellectual property will be deleted, and you will be informed of the actions taken.
Disclaimers and Limitation of Liability
Barring any express warranties provided in these Terms of Service, or a separate written agreement between you and us, the platform is provided "AS IS", without warranties of any kind. You agree to use our platform at your own risk. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including but not limited to, implied warranties of quality, performance, suitability, accuracy, and non-infringement. We do not warrant that our platform will provide continuous, prompt, secure, or error-free service.
By using our platform, you agree that Dacia Club Nederland's liability is limited to the maximum extent permissible in your country of residence. You agree to defend and indemnify us from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms of Service. This includes your use of our platform and content provided by you or other users.
Governing Law and Jurisdiction
These Terms of Services shall be governed by and construed in accordance with the law of the Netherlands. The parties involved irrevocably agree that the Dutch courts shall have exclusive jurisdiction over any claim or matter arising under or in connection with these Terms of Service.

In the event that any provision of these Terms of Service is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary. The remaining provisions of these Terms of Service will remain in full force and effect.
